Plaintiff, Michael Glover is an older man who is not able to have children with his young wife, Sierra Glover. He has a medical condition that results in a low sperm count that makes it very difficult for him to have children. He was so intent on having a baby that he paid his 22 year old neighbor, Defendant Douglas Farley, $5000 to have sex with his wife on a regular basis in order to have his wife become pregnant. Mr. Glover drew up a contract to have Mr. Farley impregnate his wife with the understanding that the Glovers would have sole custody of the child and that Mr. Farley would have no parental rights. The agreement was that during the day, while Mr. Glover was away at work, Douglas Farley and Sierra Glover would have sex on a regular basis in the Glover house and bedroom. All parties agreed to the contract that Mr. Glover drew up. Unfortunately, during their conjugal visits the young man and Mrs. Glover fell in love with each other. They continued having regular sex while using protection to prevent pregnancy. Michael Glover discovered this deception and demanded Douglas Farley pay back the $5000. Mr. Farley has refused to do so. Now Mr. Glover wants the court to legally force Douglas Farley to pay back the $5000. In addition Mrs. Glover now wants to leave Mr. Glover and run off with Mr. Farley. She is a witness on behalf of Mr. Farley and against her husband. Michael Glover is extremely distraught over the loss of the $5000 but much more so over the loss of his wife. He wants desperately to win her back. Mr. Glover is suing Douglas Farley for breach of contract in the amount of $5000. The case is brought to court and Judge Ross is to decide the outcome after hearing the testimony of those involved.
